Lawsuit was turned over! Santipab Intarapat lost in the lawsuit. Administrative court has dismissed the case accused by Santipab that SAT used its administrative power unfairly. It revoked the license of Muaythai Association of Thailand and approved Amateur Muaythai Association of Thailand instead by making decision in 3 days only. The administrative court made a final judgment that revocation of license and reestablishment of the association was consistent with regulatory Act of Sports of Thailand. Therefore, it revoked the judgment of civil court and dismissed the case, ended 5-years-long conflict.

After Mr.Santipab Intarapat, the president of Muaythai Association of Thailand made an appeal to the administrative court for the case that Sports Authority of Thailand (SAT) used its administrative power unfairly by revoking the license of Muaythai Association of Thailand and approved the establishment of Amateur Muaythai Association of Thailand instead. In this matter, the long conflict lasts 5 years. Lately, on 25 May 2010 at the courtroom 2 on the third floor, Administrative Court, Jangwattana Road, the court sentenced the case that Mr.Santipab Intarapat, the president of Muaythai Association of Thailand accused on Sports Authority of Thailand and Amateur Muaythai Association of Thailand at 10.30 a.m. The court announced to the plaintiff and defendants that the court would read the part of judgment only since there were many pages of the detail. After that, the court read the judgment as follows.

After the administrative court has dismissed the case, Mr.Santipab Intarapat, the president of Muaythai Association of Thailand, who came to hear the judgment on his own, revealed that he admit the judgment and congratulated with Amateur Association and Sports Authority of Thailand for winning the lawsuit. For himself, he had to close the association. However, he still had the position of president of Asian Boxing Association. He also revealed that he needed to relax for a while. He would work in what he like and specialized in but he would not quit from sports society. He might continue to organize kickboxing. After that, Mr.Santipab left early allowing Mayuree Wannasakulcharoen, association treasurer, to congratulate with SAT and Amateur Muaythai Association side.

Dr.Sakchai Tapsuwan, the president of Amateur Muaythai Association of Thailand, did not come to the courtroom but he sent his representatives, Mr.Kajorn Prawsri and Mr.Tawee Tangtaptim to listen to the judgment. After being informed about the dismissal, Dr.Sakchai Tapsuwan was glad that he received justice from administrative court because Amateur Muaythai Association has never violated any regulations and policies of SAT since the foundation of the association.

In addition, he has been supporting Muaythai and always opposes to change from Muaythai to be boxing. However, he receives no response from relevant government sport organization. Another important point is pushing Muaythai into Olympic Games in order to make it an international sport among the other 60 sports approved by IOC. This will be completed within the next two years with support from General Pijit Kulavanich, privy councilor, major general Sanan Kachornprasart, deputy prime minister, and General Chetta Thanajaro.

ศาลปกครองตัดสินยกฟ้องสันติภาพฟ้องกกท.คดีมวยไทย

คดีพลิก! สันติภาพ อินทรพัฒน์ แพ้คดีศาลปกครองสูงสุด พิพากษายกฟ้องคดีที่ สันติภาพ ฟ้อง กกท. ใช้อำนาจทางปกครองไม่เป็นธรรม เพิกถอนใบอนุญาตสมาคมมวยไทยแห่งประเทศไทย และอนุญาตจัดตั้งสมาคมมวยไทยสมัครเล่นแห่งประเทศไทยขึ้นมาแทน โดยใช้เวลาพิจารณาอนุญาตเพียง 3 วัน ศาลปกครองสูงสุดชี้ขาดว่า การเพิกถอนใบอนุญาตและการจัดตั้งสมาคมใหม่เป็นตามข้อบังคับของพรบ. การกีฬาแห่งประเทศไทย จึงกลับคำตัดสินของศาลชั้นต้นและพิพากษายกฟ้อง ปิดฉากความขัดแย้งที่ยืดเยื้อมายาวนานถึง 5 ปี

หลังจากที่  นายสันติภาพ อินทรพัฒน์ นายกสมาคมมวยไทยแห่งประเทศไทย  ดำเนินการฟ้องศาลปกครองสูงสุด ในกรณีที่การกีฬาแห่งประเทศไทย (กกท.) ใช้อำนาจทางปกครองไม่เป็นธรรม  เพิกถอนใบอนุญาตสมาคมมวยไทยแห่งประเทศไทย และอนุญาตจัดตั้งสมาคมมวยไทยสมัครเล่นแห่งประเทศไทยขึ้นมาแทนนั้น ซึ่งในเรื่องนี้มีการต่อสู้กันมาอย่างยาวนาน 5 ปี ล่าสุดเมื่อวันที่  25  พ.ค. 2553 ที่ผ่านมา  ณ ห้องพิจารณาคดี  2  ชั้น  3   ศาลปกครองสูงสุด ถนนแจ้งวัฒนะ   ศาลออกนั่งบัลลังก์พิพากษาคดีที่นายสันติภาพ อินทรพัฒน์ นายกสมาคมมวยไทยแห่งประเทศไทย  ฟ้องการกีฬาแห่งประเทศไทยที่ 1 และสมาคมมวยไทยสมัครเล่นแห่งประเทศไทยที่ 2 เมื่อเวลา 10.30 น.  โดยศาลแจ้งกับผู้ฟ้องคดีและผู้ถูกฟ้องคดีว่า โดยที่รายละเอียดคำพิพากษามีจำนวนหลายหน้า ศาลจะอ่านเฉพาะส่วนที่เป็นคำพิพากษาเท่านั้น หลังจากนั้นจึงได้อ่านคำพิพากษาดังนี้

ซึ่งหลังจากที่ศาลปกครองสูงสุดตัดสินยกฟ้อง สรุปคือสมาคมมวยไทยแห่งประเทศไทย ที่มี นายสันติภาพ อินทรพัฒน์ เป็นนายกสมาคมฯ ซึ่งได้เดินทางมาฟังคำพิพากษาด้วยตัวเอง ได้เผยว่า ยอมรับในการตัดสินของศาล และยินดีด้วยกับทางสมาคมมวยไทยสมัครเล่นฯ  และการกีฬาแห่งประเทศไทย ที่ชนะคดี สำหรับตนนั้น ก็คงต้องปิดสมาคมฯ ลงไป แต่ว่าตำแหน่งประธานมวยแห่งเอเชียของตนนั้นยังคงอยู่ พร้อมทั้งเผยว่า ต่อจากนี้ก็คงต้องพักผ่อนสมองอีกสักพัก ไปทำงานในสิ่งที่ตนชอบและถนัด แต่ไม่ทิ้งวงการกีฬา อาจจะไปดำเนินงานจัดทำคิกบ็อกซิ่งต่อไป จากนั้นนายสันติภาพก็ขอตัวกลับที่พักอย่างรวดเร็ว ปล่อยให้ มยุรี วรรณะสกุลเจริญ เหรัญญิกสมาคมฯ เข้าไปจับมือแสดงความยินดีกับฝั่งของกกท. และสมาคมมวยไทยสมัครเล่นฯ
 
ด้าน ดร.ศักดิ์ชาย ทัพสุวรรณ นายกสมาคมมวยไทยสมัครเล่นแห่งประเทศไทย ที่ไม่ได้มานั่งฟังคำพิพากษา แต่ได้ส่งตัวแทน นายขจร พราวศรี, นายทวี แตงทับทิม มานั่งฟังคำพิพากษา เมื่อทราบข่าวว่าศาลพิพากษายกฟ้อง ดร.ศักดิ์ชาย เผยว่า  หลังจากที่ได้ฟังคำพิพากษาแล้ว ดร.ศักดิ์ชาย ทัพสุวรรณ รู้สึกดีใจที่ได้รับความเป็นธรรมจากศาลปกครองสูงสุด เพราะตั้งแต่ตั้งสมาคมฯ มา   สมาคมมวยไทยสมัครเล่นแห่งประเทศไทย ไม่เคยปฏิบัตินอกเหนือข้อบังคับและนโยบายของกกท.เลย
             
นอกจากนั้นยังได้ดำเนินการส่งเสริมกีฬามวยไทยและต่อต้านการเปลี่ยนชื่อมวยไทยเป็นมวยมาตลอดเวลา แต่ไม่ได้รับการสนองตอบจากองค์กรกีฬาภาครัฐบาลที่เกี่ยวข้อง ประเด็นสำคัญอีกอย่างคือการนำกีฬามวยไทยเข้าสู่การรับรองของกีฬาโอลิมปิกสากล  เพื่อเป็น 1 ใน 60 ชนิดกีฬาที่โอลิมปิกสากล (ไอโอซี IOC)  รับรองแล้ว โดยจะดำเนินการให้เสร็จภายใน 2 ปีข้างหน้า ทั้งนี้ด้วยความกรุณาสนับสนุนของ ฯพณฯ พลเอก พิจิตร กุลละวณิชย์  องคมนตรี,  ฯพณฯ  พลตรี สนั่น ขจรประศาสน์ รองนายกรัฐมนตรี และ พลเอก เชษฐา  ฐานะจาโร
